Practice Areas
The law office of David Eisenberg, PLC offers exceptional legal representation to individuals in the greater Phoenix area and throughout Arizona who are under investigation or have been charged with a crime. As a former prosecutor, Mr. Eisenberg has particular insight into the inner workings of the criminal justice system, and uses this knowledge to anticipate the tactics and strategies the prosecution will use against his clients.
The firm defends clients against allegations of:
White Collar Crimes
Mr. Eisenberg focuses much of his practice on representing defendants charged with committing nonviolent, financially-motivated crimes. Mr. Eisenberg has particular expertise in the defense of white collar crimes, having been appointed as Associate Independent Counsel for HUD, and serving as an adjunct professor of law teaching trial practice and white collar crime at Arizona State University.
White collar crimes often carry serious penalties, and, after a series of nationally-publicized corporate scandals, district attorneys are prosecuting these offenses more aggressively than ever. While these charges are often associated with the corporate and financial sector, regardless of one's livelihood, white collar criminal matters typically involve a complex web of legal and evidentiary considerations. Penalties for these crimes vary in Arizona, but can be very serious: in some situations, the consequences of a conviction can include having no eligibility for reduction, parole, or probation.
Many lawyers offer general criminal defense services. For a white collar defendant, however, this background does not offer the level of legal ability needed to provide adequate representation. Mr. Eisenberg has represented defendants facing a wide range of white collar charges, including:
- Embezzlement
- Bank fraud
- Mortgage fraud
- Mail fraud
- Securities fraud
- Tax evasion
General Criminal Defense
Outside of his work in the white collar criminal arena, Mr. Eisenberg also provides representation for clients facing a range of other charges in federal, state, superior, and municipal courts. In particular, Mr. Eisenberg has significant experience with regard to criminal forfeiture proceedings (typically post-conviction) in which the state seeks to confiscate property from the defendant that was allegedly obtained for an illegal purpose. Mr. Eisenberg's experience also extends to many other areas of criminal defense, including:
- Burglary
- Theft
- Racketeering
- Customs and immigration violations
- Homicide/violent crimes
- DUIs
Criminal Appeals
A conviction is not the end of the line; a defendant still has the right to challenge a trial court's ruling. Courts of appeal will closely review not only the substantive merits of a conviction, but the soundness of the trial procedure in reaching that conviction. For an individual who has just received a criminal sentence, considering whether to challenge the conviction-and on what grounds-requires the advice and assistance of an attorney with experience in criminal appeals. Equally worrisome are the prospects of retaining the same defense attorney who was unsuccessful at trial, or relying on a defense attorney unfamiliar with the appellate process.
Mr. Eisenberg serves on an appellate panel for the U.S. Court of Appeals for the Ninth Circuit, and is frequently appointed by the court to serve as counsel in criminal appeals. With extensive experience in both federal and state appellate courts, Mr. Eisenberg offers effective representation for defendants seeking to appeal their conviction.
Personnel Removal Proceedings
Doctors, lawyers, government employees, civil service workers, and other professionals threatened with disciplinary removal are often facing a seemingly insurmountable adversary. Mr. Eisenberg is dedicated to representing his clients in a range of personnel removal and administrative proceedings, providing clients with the representation needed to protect their constitutional rights and financial entitlements.
